Rental Terms and Conditions

 

1) RESERVATION POLICY: Before I can accept your reservation, the party leader must read these terms and conditions. Unless the party leader advises to the contrary in writing, it will be deemed that the party leader agrees to these terms and conditions for and on behalf of all members of their party and their guests and binds them jointly and severally to them.

 

2) CANCELLATION POLICY: The time factor is critical in vacation rentals, and your reservation deposit will hold this rental off the market for a period of time. If you cancel for any reason after I have emailed your Reservation Confirmation, your deposit will not be refunded. If you cancel after the balance has been paid and between 2 and 9 weeks prior to the start of vacation rental, 50% of the balance will be refunded. If you cancel less than 2 weeks prior to the start of vacation rental, there will be no refund.

 

3) PROPERTY CONDITION / SECURITY DEPOSITS: When you arrive, please check the vacation rental for cleanliness and damage. Notify me promptly of any problems or damage. You agree to leave the vacation rental in arrival condition with no physical damage and with vacation rental, gardens and pool/spa area neat and tidy, dishes washed and put away, spills wiped up, barbeque cleaned and trash removed to bin in garage. Late check-out, trash left in kitchen, trash left on road side, excessive utility charges, non return of the vacation rental key or vacation rental, gardens and pool/spa area needing more-than-reasonable cleaning are all grounds for security deposit claims. If there is no problem the security deposit will be returned to you by mail within 14 days after your date of departure. If I am going to make a claim on your security deposit, I will email you describing the details within 14 days. Additional Cleaning Charge: $50 per hour. Late Checkout Charge: $50 per hour.

 

4) THE OWNER SETS SPECIFIC RULES regarding the maximum number of occupants, pets, smoking, etc. As the vacation rental owner, I or my agent enforce these rules, and may evict rentors or their guests when they are exceeded. Only the number of guests agreed when the reservation is made may stay at the vacation rental. No other persons may visit the vacation rental unless agreed in writing when the reservation is made. Large gatherings, house parties, etc., are absolutely not allowed unless agreed in writing when the reservation is made. Pets are not allowed at the vacation rental, and that includes pets belonging to your guests, unless agreed in writing when the reservation is made. Absolutely NO SMOKING is allowed inside the vacation rental. Sub-letting is not permitted. Any disturbance resulting in neighborhood complaints, police action, other illegal activities, illegal drug use, damage to the vacation rental, or violation of this agreement will be considered sufficient cause for immediate termination of your stay, and all monies paid will be forfeited. This agreement does not create a tenancy for the vacation rental; you can be removed from the vacation rental without process of law if you do not depart by the agreed time.

 

5) THE OWNER AND AGENT ARE NOT RESPONSIBLE for the safety of rentors, their families or their guests or for the loss or theft of or damage to their belongings whilst at the vacation rental. Due to deep water, steep gradients and high walls in parts of the gardens and grounds, rentors, their families and their guests agree to fully supervise their children at all times. Rentors and their guests agree that there is no lifeguard for the pool or spa and that supervision is entirely their responsibility.

6) YOU AGREE TO NOTIFY THE OWNER OR AGENT IMMEDIATELY if a problem of any kind develops at the vacation rental. If you fail to do this, no responsibility can be accepted as the Owner and Agent have been deprived of an opportunity to investigate and rectify the problem. The Owner and Agent reserve the right to make repairs as necessary, and to enter the vacation rental with reasonable notice, or without notice if you cannot be reached, to quickly remedy any problem.

7) QUIET ENJOYMENT: Rentors and their guests agree not to violate the quiet enjoyment of the surrounding neighbors and to respect their privacy and property.

8) KEYS: The house key will be made available to you at the vacation rental from 4pm on the day of your arrival and must be left at the vacation rental after you have locked up the house on your departure.

9) YOU ARE RESPONSIBLE FOR YOUR CHOICE. This vacation rental is individually owned and managed. I have described the vacation rental in detail to the best of my ability, but I cannot make the decision for you and will not be responsible if you are not happy with your choice on arrival. The rent will not be refunded and cannot be transferred to another location.

10) LONG DISTANCE AND INTERNATIONAL TELEPHONE CALLS: You are responsible for all your long-distance and international call charges. You can receive incoming calls except Collect ones, and make outgoing local and toll free calls, but you cannot make outgoing long-distance or international calls except Collect or by credit/charge/calling card. 

11) WEATHER CONDITIONS/ACTS OF GOD: The owner is not responsible for any weather condition or acts of God or nature that may happen and no refunds will be made. Further the owner shall not forfeit the rental amount if you cannot get to, or stay in, the property due to any weather conditions or acts of God or nature. Travel insurance is strongly recommended.

12) THE POOL & SPA: You are responsible for safe operation of the Pool and the Spa and the related equipment. You accept that the Pool may take some time to heat up in cool weather and you agree that the Pool will be heated to a maximum of 85°F and the Spa to a maximum of 98°F.

13) CHECK-IN/CHECK-OUT TIMES: Check-in time is to be no earlier than 4 pm. Check-out time is to be no later 10 am.

14) PRIVACY POLICY. We collect demographic data and personal data during the reservation procedure; however, your personal details will remain private and confidential. We will never sell, rent, barter or share your personal details in any way with any other company. All data collected is for our internal use only.

15) PAYMENT. The reservation deposit is 35% of the rental rate and is payable by debit or credit card. The rental balance and the refundable security deposit are payable 2 months prior to rental and we will then email our ‘Book of the House’ that contains the arrival procedures and comprehensive information about the house and area. Payments will processed in UK£ at the commercial rate and, for your security, your debit/credit card details will be shredded immediately after use. We strongly recommend the use of debit cards because of their very low service charges.
